Terms of Service

Arbor designs, hosts, and maintains your website, and lets you change it by chatting with our assistant, Sage. You pay a monthly subscription, plus a one-time setup fee when one applies to your plan (we sometimes waive it during promotions). All fees are non-refundable. You own the content you give us; we own our platform. Use the service lawfully, and we'll tend your site.

These Terms of Service ("Terms") are a binding agreement between you ("you", "Customer") and Arbor ("Arbor", "we", "us", "our"). They govern your access to and use of the Arbor website at arbor.zone, the customer dashboard, and the websites and related services we provide (together, the "Service"). By creating an account, purchasing a plan, or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business.

1. The Service

Arbor provides managed websites for small businesses. Depending on your plan, this may include website design and build, hosting on our infrastructure, changes made through our automated assistant ("Sage") and/or our team, a staging preview with one-click publishing, version history, optional blog and search-optimization features, and the option to connect your own domain name. We may add, change, or remove features over time. Features labeled beta or preview are provided "as is" and may change or be withdrawn.

2. Accounts & eligibility

You must be at least 18 years old and use the Service for business purposes. You agree to provide accurate information, keep your login credentials secure, and remain responsible for all activity under your account. Notify us promptly at hello@arbor.zone if you suspect unauthorized use. Sign-in is provided through Firebase Authentication (email and password, an email sign-in link, or Google); your use of Google sign-in is also subject to Google's terms.

4. No refunds

All fees are non-refundable. Setup fees, subscription fees (including unused time), and custom-build fees are not refunded, except where a refund is required by applicable law. Cancelling stops future renewals only — it does not refund or prorate the current period.

5. Cancellation & termination

You may cancel at any time from your dashboard's billing portal or by emailing hello@arbor.zone. Cancellation takes effect at the end of your current billing period; your site and access remain available until then, after which the subscription will not renew and your site may be taken offline. We may suspend or terminate your Service for non-payment, breach of these Terms, unlawful or abusive use, or to comply with law. After termination we may delete your site and associated data following a reasonable retention window (typically 30 days), during which you may request an export of your content.

6. Your content & license to us

You retain ownership of the content you provide — text, images, logos, and business information ("Your Content"). You grant Arbor a worldwide, non-exclusive, royalty-free license to host, store, copy, modify, adapt, translate, and publish Your Content as needed to operate and improve the Service, including edits generated by Sage, staging copies, backups, and delivery through our content network. You represent that you own or have the rights to Your Content and that it does not infringe any third party's rights or violate any law.

7. Sage & AI-generated changes

Sage uses automated and AI systems to draft and modify your site based on your instructions. AI output can contain errors or omissions. You are responsible for reviewing changes and for the accuracy and legality of everything published on your site — including prices, claims, offers, and any legally required disclosures. We do not guarantee the accuracy of generated content, nor any particular search ranking, traffic, conversion, or business result.

8. Acceptable use

You agree not to use the Service to: publish unlawful, infringing, deceptive, or harmful content; distribute malware, spam, or phishing; sell prohibited goods or services; impersonate others; attempt to breach, scrape, overload, or reverse-engineer the Service; or resell the Service without our written permission. Anything you sell through your site is your responsibility and must comply with applicable laws and any third-party (including Stripe and card-network) rules. We may remove content or suspend sites that violate this section.

9. Intellectual property

Arbor and its licensors own the Service, including our software, platform, templates, design systems, Sage, and the Arbor name and marks. We grant you a limited, revocable, non-transferable license to use the Service and the website we build for your business for as long as your subscription is active. Reusable templates and platform components remain ours; Your Content remains yours. If you send us feedback, you grant us a perpetual license to use it without obligation.

10. Domains & third-party services

If you connect a domain you own, you remain solely responsible for that domain's registration, DNS, and email — Arbor will never take over your domain's nameservers or email records. The Service depends on third parties such as Amazon Web Services, Stripe, and Google; their availability and terms are outside our control, and we are not liable for their acts, outages, or changes.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation, to the fullest extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by law, Arbor will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid Arbor in the three (3) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Arbor from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, the products or services you sell through your site, or your breach of these Terms.

14. Availability

We work to keep the Service available but do not guarantee uninterrupted or uninterrupted-quality service. We may perform maintenance and may modify or discontinue parts of the Service. No service-level guarantee applies unless we agree to one in writing.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new effective date and, for material changes, take reasonable steps to notify you. Your continued use of the Service after an update means you accept the revised Terms.

16. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at hello@arbor.zone so we can try to resolve it informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to venue there.
